Wenn der Polizeiminister gren lsst

Nach seinen Enthllungen ber Kriegsverbrechen verlor der prominente kroatische Journalist eljko Peratović seinen Arbeitsplatz
Jetzt durchleuchtet er als Blogger dubiose Netzwerke – und erhlt Polizeibesuch.

“Wir haben hier eine Anzeige gegen Sie”, sagte der freundliche Polizist an der Haustr. “Sie sollen Ihr Kind unsittlich angefasst haben.” eljko Peratović hat vom Krieg berichtet. Spter wurde sein wichtigster Informant, ein guter Freund zudem, in die Luft gesprengt. Aber der schlimmste Horror war der Moment, als er an seiner Haustr in Zagreb dem freundlichen Polizisten ins Auge sah. Denn den Krieg und den Mord an seinem Freund erlebte der heute 42-Jhrige noch als Journalist. Als die Polizei bei ihm klingelte, war er nur noch Blogger. Ein Unterschied, der sehr wichtig werden kann.

eljko Peratović ist in Kroatien nicht irgendwer. Er war der Mann, der das Massaker von Gospić publik gemacht hat. Noch als Reporter der Wochenzeitung Globus schrieb er ber die Grueltaten in der beschaulichen kroatischen Kleinstadt, wo 1991, zu Beginn des Krieges, reihenweise Serben aus ihren Husern geholt und im Wald erschossen wurden. Nicht alle Kroaten mochten zu den Verbrechen schweigen. “Ich bin nicht in den Krieg gezogen, um Omas umzubringen” , sagte sich ein kroatischer Soldat und wurde zum Kronzeugen. Peratović freundete sich mit dem mutigen Aussteiger an. Aber noch bevor der Soldat aussagen konnte, ttete ihn im August 2000 eine Autobombe.
Peratović aber wurde bei Globus entlassen. Seit vier Jahren ist er nun arbeitslos und passt auf die fnfjhrige Tochter auf, whrend seine kranke Frau meistens in der Schweiz weilt. Und bloggt.

Die zentrale Rolle in den langen Geschichten auf Peratovićs Website spielt immer wieder ein Mann: Tomislav Karamarko. Der gehrt in Kroatien eigentlich zu den “good guys” . Als der heute 50-Jhrige im letzten Herbst nach einer erschtternden Serie von Mafiamorden zum Innen- und damit Polizeiminister berufen wurde, gab es viel liberalen Applaus.

Peratović aber fragte sich, was der hohe Polizist eigentlich getan hatte, als seinerzeit sein Freund in die Luft gesprengt wurde. Er leuchtete in seinem Blog die Geschfte der Sicherheitsfirma aus, die der Hoffnungstrger zeitweilig betrieben hatte: Wen hatte er da geschtzt? Wer waren die Miteigentmer? Noch als Karamarko Geheimdienstchef war, klingelte es bei Peratović schon einmal an der Tr: “Verdacht auf Geheimnisverrat.” Ein Trupp von acht Polizisten durchsuchte die bescheidene Wohnung, griff sich die Laptops, beschlagnahmte die gesamte Dokumentation und nahm Peratović mit zum Verhr. Im Jahr darauf zeigte der Geheimdienstchef den Blogger persnlich an – wegen “Ausstreuens von bekanntermaen falschen Gerchten mit dem Ziel, eine grere Zahl Brger zu beunruhigen” . Als die Anzeige zur Verhandlung kam, war Karamarko schon Minister und fhrte vor Gericht als “beunruhigte Brger” seine weitere Verwandtschaft an. Die Justiz vergrub das noch immer offene Verfahren in den Tiefen des Gerichtswesens. Als es jetzt wieder an der Tr klingelte und ein Polizist ihm mit der anonymen Anzeige wegen Kindesmissbrauchs kam, witterte Peratović wieder dessen Dienstherrn dahinter. Auch wenn er das so nicht sagt.

Le journaliste Zeljko Peratovic victime de harclement juridique

Reporters sans frontires dnonce les poursuites ouvertes le 14 janvier 2008 lencontre du journaliste Zeljko Peratovic, la demande du ministre de lIntrieur Tomislav Karamarko, qui laccuse davoir contrevenu larticle 322/1 KZA du code pnal prescrivant une peine de prison dun an et des amendes pour toute personne qui diffuserait des informations de nature inquiter la population .

Sur son blog (peratovic.net et peratovic.blog.hr), dans des courriers adresss aux autorits juridiques nationales, et dans diverses interventions publiques, Zeljko Peratovic a dnonc lobstruction pratique par Tomislav Karamarko dans lenqute sur la mort de Milan Levar, un tmoin protg du Tribunal pnal international pour lex-Yougoslavie (TPIY) dcd dans lexplosion de sa voiture, le 28 aot 2000 Gospic. Une enqute a t ouverte, dans laquelle Zeljko Peratovic a t entendu comme tmoin, puisquil figure parmi les dernires personnes avoir vu Milan Levar en vie. En violation du secret de linstruction, le procureur a ensuite rvl lidentit de Zeljko Peratovic

Le ministre Karamarko se dit victime de diffamation, et prtend que je veux inquiter la population. Il poursuit cependant un autre but. Au-del des amendes, le tribunal peut surtout dcider de minterdire, pour une dure indtermine, de diffuser de linformation. Il me priverait de fait dexercer toutes activits journalistiques, sur mon blog ou dans dautres mdias. Ceci minterdirait aussi de poursuivre mes efforts pour que lon dcouvre les commanditaires de lassassinat de Milan Levar. Certains misent galement sur la prescription dans ce dossier. Me rduire au silence constituerait une voie possible pour y parvenir , a dclar Zaljko Peratovic.

Il semble que les enqutes menes par la presse sur les crimes de guerre ne soient pas les bienvenues dans le contexte dadhsion lUnion europenne. Le ministre de lIntrieur devrait plutt sattacher la progression des enqutes sur lassassinat dun tmoin protg, plutt que de sattaquer ceux qui refusent de voir loubli et limpunit sinstaller , a dclar Reporters sans frontires.

Les poursuites tablies sur base de larticle 322/1 sont ridicules et irrecevables. La notion dinformation de nature inquiter la population constitue une vision obsolte de la libert dexpression, incompatible avec les standards dmocratiques europens auxquels la Croatie devra se conformer si elle veut rejoindre lUnion europenne , a ajout lorganisation.

Enfin, si les poursuites contre Zeljko Peratovic devaient tre maintenues, nous insistons pour que les prochaines auditions de chacune des parties ne soit plus effectues huis clos. , a conclu Reporters sans frontires.

En 2008, Zeljko Peratovic a reu des menaces de mort par la voie de commentaires publis sur son blog. Le 17 octobre 2007, il avait t arrt son domicile et plac en dtention, pour divulgation de secret dEtat. Le journaliste avait publi sur son blog (peratovic.net et peratovic.blog.hr) des documents relatifs aux crimes de guerre commis dans le village de Gospic (sud-ouest de la Croatie), dans les annes 90. Il avait, notamment, voqu lexistence dun tmoignage vido mettant en cause un des vice-prsidents du Parlement (M. Darko MILINOVIC, momentane Ministre de la Sant et de la Protection sociale) et le dfunt ministre de la Dfense, Gojko Susak.. A 42 ans, Zeljko Peratovic, risquait jusqu trois ans demprisonnement. Si les poursuites contre le journaliste nont pas progress, les charges retenues contre lui nont pas non plus t leves. Les archives qui avaient t saisies cette occasion ne lui ont toujours pas t rendues.

Zeljko Peratovic a travaill pour diffrents quotidiens dont le dernier en date est Vjesnik. Ses enqutes sur les crimes de guerre lui ont valu de graves difficults. Il a perdu son emploi, a t agress et est considr comme un tratre par une partie de la population, qui refuse lide mme que des crimes aient pu tre commis par des Croates pendant la guerre.

En 2003, il a reu le prix de la libert de la presse de la section autrichienne de Reporters sans frontires.

Vjesnik u crnim kronikama

Kae odvjetnik Zvonimir Hodak da mu se javilo troje Vjesnikovih novinara, bivih urednika te da u njihovo ime priprema tubu protiv glavnog urednika Darka Đuretka za mobbing i seksualno uznemiravanje.

ZAGREB – U ime troje novinara Vjesnika, odvjetnički ured Zvonimira Hodaka priprema tube protiv Vjesnika i njegova glavnog urednika Darka Đuretka. Novine i glavnog urednika tui dvoje bivih glavnih urednika, Kreimir Fijačko i Andrea Latinović, te biva zamjenica glavnog urednika Marijana Mikainović Jambrović.

Njih će troje Vjesnik i Đureteka tuiti zbog ikaniranja na radnom mjestu i mobbinga, a A. Latinović i M. Mikainović protiv Đuretka će podnijeti jo i tubu zbog seksualnog uznemiravanja.

- Razlozi za tubu su to su raspoređeni na poslove koji ne odgovaraju njihovoj stručnoj spremi, a to je protivno Zakonu o radu. Svima su smanjene plaće, i to drastično. Sve mirii na revanizam jer su svi bili glavni urednici, odnosno zamjenica – kae odvjetnik Hodak, dodajući da mu se javilo jo nekoliko novinara iz Vjesnika koji također namjeravaju podići tube protiv Vjesnika i Đuretka, pa čak i pokrenuti kazneni postupak.

Da je situacija u Vjesniku katastrofalna znam i sam. Prole godine su mi dali otkaz, a mobbingu sam bio izloen od strane Andreje Latinović i Marijane Mikainović Jambrović i Marijane Matković. Direktor Franjo Maletić razrijeio je moju dramu sa sadanjim tuiteljicama tako to je meni dao otkaz, a njih rasporedio na druge poslove. Naravno, nisam ja uzrokovao njihovu smjenu. Moje su predstavke bile samo povod. Izgubile su podrku vrha HDZ-a. Odnosno izgubila ju je je Andrea Latinović, koja se jo za vrijeme Kreimira Fijačka gurala na putovanja sa Sanaderom. Dirljivi su bili njeni SMS-ovi kolegama iz Vatikana kako je predsjednik Sanader poljubio ruku Svetom Ocu Papi.

Sjećam se da me Marijana Matković, trenutno raspoređena na rad u Gradsku rubriku, uvjeravala početkom 2004. da će Andreja Latinović naslijediti Fijačka jer da za nju kod Sanadera snano lobiraju Andrija Hebrang i Jadranka Kosor. Tako se i dogodilo. Fijačka su smijenili i bez javnog natječaja za glavnu urednicu imenovali Andreju Latinović. Ona je odmah izabrala svoj tim: zamjenicu Marijanu Mikainović, dugogodinju Vjesnikovu redaktoricu, pomoćnicu Marijanu Matković, novinarku specijaliziranu za socijalu, pomoćnika Zorana Vodopiju, biveg diplomata i vanjskopolitičkog novinara…

Oni su bili kadar HDZ-a. Postavio ih je direktor Franjo Maletić kojeg je Sanader poslao u Vjesnik. Smijenio ih je isti Maletić, a nikada se nisu alili da su smijenjeni iz političkih razloga. Pa to sada hoće?
U vrijeme kad sam ja maltretiran od te uprave i uredniotva na mobbing se alila i pokojna Vjesnikova dopisnica Snjeana Čanić Divić, koja je od posljedica pritisaka na poslu i preminula ove godine. Njen otac mi je najavio tubu protiv Vjesnika, ali i urednitva iz vremena kada su počeli pritisci na Snjeanu.

Nekako mi se čini da su tube obitelji Čanić protiv Vjesnika i moje daleko ozbiljnije za te novine i neke od spomenutih urednica, nego to postoji mogućnost da Hodakovi klijenti uopće podnesu tubu.

Naime, oni se nadaju da će se vijeću iz Jutarnjeg uplaiti direktor Maletić i Đuretek, pa im povećati plaće. Ako prođe, prođe… Uostalom, kakve su to ozbiljne tube kad odvjetnik zapravo i nezna za to bi konkretno optuio.

Official letter of State attorney’s office by which my suggestion for settlement related to case of POA is denied

I was informed by attorney Luka Susak that Sandra Krickovic, deputy of county state attorney, have sent official letter in Zagreb in which was said that:
After insight in whole documentation this State attorney’s office has concluded that there were no basis for assembling extrajudicial settlement.
That is the answer on Suggestion of settlement, which we sent, at the beginninig of May, to the Main state attorney, Mladen Bajic, related to conclusion of Parliamentar Committee for internal politics and national security, that there were justified doubts that POA has violated human rights of five journalists ( Gordan Malic, Ivanka Toma, Ivica Djikic, Mario Kavajin and Zeljko Peratovic).

Considering that Jarnjak’s Committee in its conclusion added that the whole documentation about research of report of five journalist would be given to State attorney’s office on further process, and that I have on my Suggestion of settlement got this answer, it can be concluded that State attorney’s office considers that there is no even justified doubts that Franjo Turek, as a chief of POA, in his Presentation to the top of the state (President Stjepan Mesic, Prime Minister Ivo Sanader, Minister Marijan Mlinaric and Minister Vesna Skare Ozbolt) violated human rights of journalists, accusing them for cooperation with domestic and foreign spies and Carla Del Ponte and spreading disinformations that fugitive Ante Gotovina was in Croatia, that was, in that way they worked against interests of Croatia.

That also means that State attorney’s office is on Franjo Turek’s side and his accusations that five journalists were doing spy activities against interests of Croatia.

If we were law-based state, now State attorney’s office sholud raise criminal charges against journalists. But we are not, and they wouldn’t.

I’m not surprised by this posture of State attorney’s office, considering that its main person (Mladen Bajic) regularly was getting reports from Franjo Turek about spy activities of journalists, even in time of Racan’s government, and that he stands on side of Turek and Bagic, and by writtings of Ivo Pukanic, as one of pillars of government, was involved in helping Ante Gotovina.

So, attorney Susak and me will take up finishing accusation against Croatia, in which we will enclose additional evidences and witnesses, representing the thesis that State has slandered me by Turek’s claims and by posture of State attorney’s office.

So, who likes to play around with rights of freedom of speech and human destinies of journalists, let he be prepared to give away money for that vice.

Norac’s amnesty

Will Stjepan Mesic amnesty Mirko Norac?

After amnesty of Stjepan Grandic, third accused in process for war crime in Gospic in 1991. and amnesty of several Serbs accused for war crimes, the preparation are coming to end for Mirko Norac, second accused in process for Gospic, ask from President Stjepan Mesic for amnesty, and he to give him.

It can not only be seen from support , which for mentioned decisions of Mesic’s Commission for amnesty had got from Ivan Zvonimir Cicak.

The truth is that Ivan Zvonimir Cicak was gracious to Mirko Norac even while Milan Levar was alive, and that he through Ante Kotromanovic stayed in connection with condemned duke for war crimes. Cicak’s closeness with Norac could be described through mutual connections with Miro Laco, Mirko Ljubicic Sveps, Tomislav Karamarko and Vladimir Faber.

That is exactly the circle which works the most on Norac’s amnesty from Stjepan Mesic.

Although, for Cicak it could be said that he protects Commission for amnesty of Stjepan Mesic, although Mesic himself was till recently most often his target for attacks, because he also was getting accusations that he was responsible as a former member of Commission for amnesty of drug dealers.

That’s why, in establishing level of preparations for Norac’s amnesty, would be the best to limit on statements of President Stjepan Mesic.

In interview to his biographer, Ivica Djikic, in the last issue of Feral Tribune, Mesic criticizes Minister of justice, Vesna Skare Ozbolt, because she criticized mentioned amnesties, and reproaches to her that in Croatia till now for war crime are convicted only three Croats and about hundred Serbs.

And when Djikic asks him why he amnestied one of those three Croats, Grandic, Mesic avoids direct answer and says that he didn’t think were those amnestied Croats, Serbs or Russians, and another his indirect responsibility ascribes to Minister of Justice:

Or, on the other side, a man shoots a bullet in head of a nineteen-year-old boy, and on trial the gun was lost, for what nobody is responsible, and in the end that killer get not full five years in prison. What kind of logic is that!? Let Minister Skare Ozbolt think over that and say what should be done to gain same standards of processing.

Right on the next page of Feral Tribune, journalist Vladimir Matijanic writes that Ranko Marijan, the judge reporter to Supreme court in case Vinko Budisa, who shot mentioned five bullets into Milenko Djekic’s head, is most deserving that killer got not full five years in prison, as Mesic said.

And very that Mesic recently suggested Ranko Marijan for President of Supreme court of Croatia.

When he is so forgetful, it is hard to expect from Mesic to remember why he didn’t object to Minister Ingrid Marinovic Anticevic, who confirmed Igor Benzon for President of County court in Split, and he could be held hierarchical responsible for disappearing of gun from court’s rooms, by which Djekic was murdered.

Benzon later gave the case Lora on process to Slavko Lozina, who were the first degree judge in case Budisa.

So, Mesic’s avoiding of mentioning Grandic, is absolutely sure sign that next step is amnesty of Mirko Norac.

Maybe Norac’s letter from prison in Glina is expected, with which from leadership of Chivarlic Association of Alkars would be asked apology for President Mesic, because his gift on Alka was refused, on which won Ivica Peric, together with two other alkars, later thrown out from the Association. Mesic already asked from Chivarlic Association of Alkars to three expelleds take back again, and then he will think about sponsorship on this year Alka.

Second signal in that Mesic’s interview is a statement that after all wars were waves of amnesties, but also must be some pardons.

All that worries international community, because ICTY should make a decision about giving case Medacki dzep (Medak Pocket), in which till now are condemned Rahim Ademi and Mirko Norac on domestic prosecution.

International community has already through last years report of OSCE, familiarised with number of Serbs who are condemned for war crimes, in relation to numbers of Croats.

Although that disparity didn’t improve recently, it is important to emphasize that report is for 2002. and 2003. , the time in which Ingrid Anticevic Marinovic was Minister of justice, Mladen Bajic principal state atorney, and Mesic’s former employees on place of President of Supreme court, Ivica Crnic.

International jurisprudent practice doesn’t mark amnesty of war criminals, so circles close to ICTY, don’t believe that Croatia will get processing in case Medacki dzep. The credit for that in this case goes to President Stjepan Mesic.

Because of all that, very naive seems wiev of Boris Pavelic in Novi list on role of Stjepan Mesic, towards jurisprudent .

Namely, Mesic’s too general explanation to medias, after he recently amnestied four war criminals that social circummstances has changed, actually suggests that Mesic has considered the fact that the same criminal acts, with different punishments, were penalised in 90-ies and today.

-The verdicts for war crime against civil population, in processes in which the accused one was burdened by commanding responsibility, and not for personally commited crimes, in the nineties were given 20 years in prison, and today for the same crimes are given 10 years in prison. Courts, of course, can’t change the decisions from that time, but it can be taken in consider in amnesty. Couldn’t, than, such change of social circummstances, consider as a reason for amnesty?, asked the source of our papers, close one to President of Croatia.

I almost forget.

Ivan Zvonimir Cicak, in Saturday’s column in Jutarnji list, claims that international community recognized results which with its work, to leadership of POA, showed Tomislav Karamarko.
What are the results? Who recognised it in international community? As far as I know, from Bruxelless, about Tomislav Karamarko, laudably spoke only Ines Sabalic.

Carla Del Ponte nicely said to Mladen Bajic when he is going to have something more concrete about Gotovina’s salaries in Italy (investigation made by Tomislav Karamarko) to let her know. And what is he going to tell her when he didn’t send Gotovina’s DNA to Italy, nor DNK from supposed general-lovers trousers to him. It must be that Ivo Sanader keep in a little distance Cicak, because he didn’t warn him that exactly from international community was said to him to give up placing Karamarko for chief of police (or, God save, bigger evil, Minister of Homeland security), about what Prime Minister informed only Davor Butkovic.
