MUNICIPAL COURT IN ZAGREB

Legal matter:

PROSECUTOR: PERATOVIC ZELJKO, from Zagreb, III Pile 25
Represented by: attorney Irena Radic

DEFENDANT: VJESNIK P Ltd., Zagreb, Slavonska avenija 4

COMPLAINT

Because returning employee on job and payment of lost salary

I The prosecutor is employee of the defendant on undetermined time on employment position journalist-senior associate IV, and which labour relation is regulated by Work contract on undetermined time since 18.02.2002. year.

On the day 04.08.2005. the defendant brought Resolution of irregular dismissal of Work contract, by which for the prosecutor is canceled Work contract because of serious violation of working duty for reason because on the day 22.07.2005., as the author, have published a big interview with Pavle Gazi in public paper Feral Tribune, and he didn’t ask for consent of his employer. Therefore, the defendant consider that the prosecutor in that way commited specialy serious violation of working duty, by which is disrupted relation of confidence of employer and worker and because of such act of the prosecutor continuation of working relation is not possible. Furthermore, the defendant in explanation of Resolution of irregular dismissal of Work contract quote that the prosecutor in 2002. was warned for not fulfilling his obligations in accordance with regulations in Book of working regulations, because, namely he was fulfilling his works in unsatisfactory way by range and quality.

The prosecutor in legal term on day 29.08.2005. made appeal on subject resolution.

EVIDENCE: expected recognition from the defendant, the Work contract of the prosecutor since 18.02.2002., copy of the defendant’s Resolution of irregular dismissal of Work contract since 04.08.2005., copy of the prosecutor’s objection since 29.08.2005., if necessary other evidences

II After enclosed objection, the prosecutor received a resolution of employer-defendant, by which the defendant determine that there is no basis for changing Resolution of irregular dismissal from 04.08.2005. because the prosecutor violated rule article 5 of Work contract and article 56. section 1. point 16. of Book of working regulations.

Article 56. section 1. point 16. of Book of working regulations says: that worker must esteem article 92. of Law of work (legal prohibition of match), and section 2. of the same article says: because of disregard of this working duty the employer can cancel Work contract, and if it is especially hard violation by which the process of work is obstructed, and in that or another way, cause material damage or obstruct reputation of papers Vjesnik, an irregular dismissal of Work contract can be given. In accordance with previously quoted regulation of Book of working regulations comes that violation made by prosecutor is no such hard violation of working duty which would justified irregular dismissal, so this Resolution of irregular dismissal to prosecutor illegal.

Furthermore, the prosecutor quote that he thinks that by publishing of subject interview in public papers Feral Tribune didn’t make any material damage to the defendant, or his reputation obstructed or in any other way obstructed the working process, so the conditions from article 56. section 2. of Book of working regulations for giving irregular dismissal of Work contract to the prosecutor are not fulfilled. Also th edefendant in explanation of Resolution of irregular dismissal of Work contract and in answer on objection of the prosecutor didn’t explain in any way subject resolution, although he referes on rules of Book of working regulations which clearly and briefly found reasons for making Resolution of irregular dismissal of Work contract. Namely, by article 114. of Law of work the parties can irregularly dismiss Work contract: if because of especially hard working violation or because of some other especially relevant fact, considering all conditions and interests of both contract parties, the continuation is not possible. Considering that article 56. section 2. of Book of working regulations clearly points out reasons for irregular dismissal of Work contract, the prosecutor claims that the same are not fulfilled and that this Resolution of irregular dismissal illegal, because it is not in accordance with demands from Book of working regulations, which is used in making this very Resolution of irregular dismissal.

In favor of this claim that subject Resolution is illegal, emphasized is that is well-known that such offence done by journalists who work at defendant, don’t have irregular dismissal of Work contract as a result. Namely, in 2003. the journalist of defendant, Marijana Matkovic and journalist Adriano Milovan, cooperated with other medias and because of that cooperation punished with destimulation of salary in amount of 1.000,00 kunas, although at that time was on rule also subject Book of working regulations and article 56. section 1. point 16 and 2 of the same one. It is obvious that the defendant by making disputable Regulation of irregular dismissal of Work contract towards the prosecutor didn’t act in the same way towards other employees, because for such violation only to him is irregularly dismissed Work contract.

The prosecutor also wasn’t getting his salary since the day of termination of working relation, and that is 16.08.2005. when the prosecutor got Resolution of irregular dismissal of Work contract from the defendant.

EVIDENCE: expected recognition of the defendant, the Book of working regulations of the defendant, Work contract of the prosecutor, interrogation of the prosecutor, interrogation of witness Marijana Matkovic and Adriano Milovan, both on address of the defendant, by need financial expert evaluation, by need others evidences

III The prosecutor quotes that disputable interview which he published in public papers Feral Tribune and whic on the day 22.07.2005. and publicly published in mentioned public papers, made out of his working time, and that he in accordance with regulations of Work contract, on the day 11.07.2005. at 14:54 hours handed over to the chief editor Andrea Latinovic, who without any explanation disallowed its publishing, and for which direct cognitions has editor Nada Dmitrovic. On the day 12.07.2005. the prosecutor talked with assisstant of the director, dr. Goran Popovic about diputable text, and he was ready to make corrections in that text, and all in accordance with the defendant’s general editor approach, who informed him that he would talk to the chief editor of the defendant, Andrea Latinovic, and that he would be informed about everything in time. Considering that he didn’t get any oral or written explanation, the prosecutor led by journalist principals of in time and truthful informing of public decided to publish the interview in public papers Feral Tribune on his own expense. The prosecutor is a journalist whose texts were awarded by international journalist associations (The award of Reporters without borders of Austria, by award Press Freedom Award 2003.) because of in time and truthful informing of public, and his decision to publish this text without approval of the defendant, was only made led by journalist principle of in time and truthful informing of public.

On quotes in Resolution of irregular dismissal of Work contract since 04.08.2005. that the prosecutor even in 2002. was warned that he didn’t fulfill his obligatios in accordance with rules of Book of working regulations, because he supposedlly unsatisfactory was doing his job by range and quality, the prosecutor says that subject quotes are not accurate, and in favour of that he quotes the fact that at that time he was by chief editor Kresimir Fijacko and his deputy, Miroslav Lezaja and executive director, Zlatko Herljevic, suggested for award of Croatian journalist association fir investigative journalism, and what he wouldn’t be for sure so if the prosecutor worked his job in unsatisfactory way by range and quality.

EVIDENCE: interrogation of the prosecutor, interrogation of witness Nada Dmitrovic, Goran Popovic, both on the address of the defendant, by need other evidences

IV Considering that the defendant refuses to take the prosecutor back to work and pay him off his lost salaries, the prosecutor suggests that court give

v e r d i c t

1. The Resolution of the defendant from 04.08.2005. of irregular dismissal of Work contract is canceled and to the defendant is ordered to take back the prosecutor on his job on which he was working before illegal termination of working relation in term of 8 days.

2. To the defendant is ordered to pay off the lost salaries to the prosecutor since 16.08.2005. till taking back the prosecutor on work, together with belonging lawful default interest since the day of arrival of every single monthly amount of salary till the pays off, and also to compensate to the prosecutor the trial costs, and all in term of 15 days.

TIDLIGERE MILITRPOLITIMANN MARIO BARISIC BESKYLDER HYTSTENDE MILITRE FUNKSJONRER FOR LORA

Tvrtko Pasalic

Monday, October 10th, 2005
Interview for Novi list Rijeka, 12. 09. 2005

Mile Cuk & Mihael Budimir

Fengsel for uregistrerte

Witnesses Markov and Sanader

Witnesses Ante Markov and Ivo Sanader

To law charges against the state, for illegal manipulations I was exposed to by POA, I will enclose also names of witnesse Ante Markov, parliamentary representative of HSS and Prime Minister, Ivo Sanader.

I will suggest Markov because of this statement:

THE PRESIDENT OF COUNCIL FOR NATIONAL SECURITY OF CROATIAN PARLIAMENT, YESTERDAY
IN ZADAR BROUGHT OUT THE NEWS ABOUT RUNAWAY GENERAL

Markov: Croatian secret services in conntact with Ante Gotovina

I’m not in conntact with general, but I can confirm that Croatian secret services are, said in brief conversation after press conference Ante Markov.

Sinisa KLARICA, Novi list, 28.06.2003.

Namely, Franjo Turek, at that time chief of POA, was signing operative reports, analysing my texts about Gotovina, claiming that it was uncorrect and that I work against interests of Croatia. Turek was sending those reports to Ante Markov, and who, besides he knew for conntacts of Ante Gotovina and Croatian secret services, as he said to Sinisa Klarica, allowed Turek’s further manipulation over me and accusations that I work against interests of Croatia. If yet Turek would say that interest of Croatia was that our secret services are in conntact with Gotovina, I would confess that I have worked against such state interest.

Recently to public was showed Turek’s letter to Council for internal politics and national sacurity, addressed to President of Council, Ivan Jarnjak, in which he complainted on conclusions of Council which was founded in case of five journalists. Turek claims that with all his work was familiar Prime Minister Sanader, who after Presentation about enemy activities of journalists and former chief of police, Ranko Ostojic, appreoved warrant for doing such new measures of secret surveillance of POA over Ostojic.

Turek publicly confirmed that quotations published in medias from his letter to Ivan Jarnjak, were accurate.

Because of that I’m more convinced that Prime Minister Ivo Sanader was very familiar with Turek’s jobs on protection of Ante Gotovina and accusations of the journalists. Turek’s recent claims confirmed also statement of Dusan Miljus, editor in Jutarnji list, gave to Boris Pavelic for Novi list:

APPEARED THE SEVENTH JOURNALIST WHOM COUNTERINTELLIGENCE AGENCY WAS FOLLOWING AND EAVESDROPPING

HDZ had materials of POA even in December 2003?

We have the tape of your conversations with chief of the police, Ranko Ostojic, threatened to Dusan Miljus, journalist of Vecernji list in December 2003 spokesman of HDZ, Ratko Macek.

ZAGREB We have on tape your conversations with chief of police, Ranko Ostojic, and you give greetings to Zinka Bardic and journalist of Jutarnji list, Ivanka Toma, because you are all members of one group-that in December 2003., in time between elections and taking over the ruling, to journalist of Vecernji list, Dusan Miljus, said at that time spokesman of HDZ, Ratko Macek, who works today also as spokesman of Government of Ivo Sanader.

Boris Pavelic, Novi list, 16.02.2005.

This is also proof that Ivo Sanader with illegal materials which he got from Franjo Turek (maybe even before the elections) intented in Miljus’s case, through his subordinated spokesman, Ratko Macek, tried even to blackmail the journalists.

I tried to settle with Government, because POA violated and still do, my human rights. It didn’t work out. In the name of Government, County state attorney’s office denied my suggestion as unfounded. Now Prime Minister Ivo Sanader will get an opportunity to explain on court his role in violation of human rights of journalists by POA.

Hereby we proudly announce Nada Peratovic’sWelcome to Absurdistan“. Zeljko Peratovic’s wife tells story about Croatian (sur)reality on German.

Carla del Ponte & Ante Gotovina by Stiv Cinik

Gotovina under franciscan’s skirts

Is Ante Gotovina under skirts of franciscans in Krapanj?

Jasna Babic

Now even Jasna Babic in Slobodna Dalmacija started with critics on Catholic Church because of hiding Gotovina, and till recently, writing for Vecerni list, she was pointing at domestic betrayers in intelligence underground, who thought that Gotovina should tell his story in Haag, and that domestic secret services, police not even the church, shouldn’t help in his escape.

I’m surprised that Babic changed her mind when it is about Gotovina and his helpers, because she way loyal to that team till now. Among Gotovina’s logistics, her the greatest favourite, Nikola Kristo, who came into Cedo Prodanovic’s office offering that Cermak’s lawyer and friend of President Mesic, mediate at ICTY about conditions that Gotovina was offering to talk to Haag’s investigators. Nikola Kristo, together with Ante Gotovina, was visitig vicar Zlatko Sudac in Betanija, after what the stigmatic and carismatic priest, concluded that runaway general was a great and kind man and that he shouldn’t surrender to ICTY.

Stigmatic Zlatko Sudac, friend of Ante Gotovina

As I can remember, only Mladen Plese, present chief editor of Slobodna Dalmacija, and present chief of Jasna Babic, even in 2002., while they were working together in Nacional, critisized Gotovina’s escape, and in context of helper, was mentioning parts of Catholic church. That Plese’s text in 2002. confirmed the indications that I was getting, from the field Gotovina was moving on, and from different foreign journalists, who were getting confirmations from their governments.

Dear readers of 45 lines, if your memory is correct, President Mesic spoke in 2002. to Pope Ivan Pavao 2, with request that Principal master of Catholic Church calm down those right-sided bishops , who were supporting Gotovina.

And then Ante Gotovina through Hrvoje Petrac and Ivo Pukanic, with assisstance of Zeljko Bagic and Franjo Turek, offered to President Mesic a deal which he couldn’t refuse.

As Carla Del Ponte doesn’t fall on charm of Kristijan Horvat (Ante Gotovina), and not even on winking of rather older charmin man, Stjepan Mesic, our President got himself in troubles head over heels, and now swimming out of that dirt, at the times, say something stupid to fence himself from Gotovina and Petrac.

Policemen of Ranko Ostojic from Police station of Sibenik-Knin, even in 2002. were supervising island Visovac, because there were informations that friars on that island were guarding Gotovina, that was, made possible for him to move through Croatia and Bosnia and Herzegovina, not stopped by the police, hiding under their dresses. Visovac is under interference of Split’s franciscan’s province.

Nevertheless, friar’s monestery on island Krapanj, opposite of Brodarica, is under interference of Zadar’s province of Sveti Jeronim and it is not surprising that Zadar’s franciscans feel called by name the most in the last interview with Carla Del Ponte.

From Krapanj, for Ante Gotovina it was not difficult to sail to Kaprije, where he had holidays in 2003., as it was written. Because of liking that information in public, Franjo Turek, at that time chief of POA, replaced by the end of 2003 the chief of his spy branch Davor Matesic.

All that quotations about shelters on Hvar, Vis or again at fra Petar Krasic in Masna Luka, are only fruit of cooking of present chief of POA, Tomislav Karamarko, so the binoculars for Gotovina would turn on other side where he is not.

Also the trousers found in Italy and many other examples about which I on 45 lines wrote in details, because Karamarko didn’t let me to write about that in Vjesnik.

Epilogues Gotovina’s escape

Is the chief of POA in Sibenik replaced because of Gotovina

According to one explanation, Davor Matesic is replaced because he didn’t collect evidences for defense of runaway retired general Ante Gotovina, and according to another, because he didn’t prevent liking of information about last summer Gotovina’s staying on Kaprije island, near Sibenik/Council for civilian supervision of secret services is the only one authorised to investigate that case

ZAGREB, 9th November Franjo Turek, chief of Counterintelligence service (POA), replaced Davor Matesic, the chief of Sibenik’s branch of POA, several days after dissolution of Croatian Parliament. By that, intelligence analysts say, he finished the process of cleaning in POA, using Parliamentry vacuum, till foundation of another convocation of Parliament and forming Parliamentary Committee for internal politics and national security, under which authorisation are secret services.

Unofficially, exactly from circles of former members that Parlamentary Committee, can be heared complaints on Turek’s move, which is evaluated as political, because Matesic was considered as a man of Minister of police, Sime Lucin. While POA was under authorisation of Ministry of police (MUP), Sime Lucin didn’t let Turek to touch Matesic. It is well known that Sime Lucin and Ivan Ninic, the member of Parliamentary Committee for national security, was against confirming Turek for chief of POA, and for a while that was also done by Prime Minister, Ivica Racan. Turek has used Parliamentary vacuum and by replacement of Matesic touched those who were against him, explains to Vjesnik a source close to former Parliamentary Committee for internal politics and national security.

Formally, Matesic’s replacement was explained by bad working results and bad human relations in Sibenik’s branch of POA. Unofficially was added that it was taken against Matesic weak engagement in collecting evidences which could help in defense of runaway retired general Ante Gotovina in ICTY, in operation led by special advisor for national security of President of Croatia, Zeljko Bagic, main state attorney, Mladen Bajic and chief of POA, Franjo Turek.

The Vjesnik’s source added that Matesic’s replacement could have something with Gotovina case, but in connection of statement of Carla Del Ponte in Luxembourgh that runaway general was on vacation last summer on one yacht in Mediterranean. As Vjesnik wrote, some sources claimed that the yacht with Gotovina was anchored near Sibenik’s island Kaprije. The source close to former Parliamentary Committee emphasizes that Turek, among other things, took against Matesic because that information appeared in public.
When once in Slobodna Dalmacija was published document of SZUP (former name of POA, auth. remark) that till recently President of Parliamentary Committee for national security, HSS man, Ante Markov, was reserve worker of that service, Franjo Turek personally accused Matesic for being responsible because that document appeared in public.

Ante Markov

But, then Turek didn’t have prooves for that accusation, and Matesic was under Lucin’s protection, so no replacement could be done, which recentla happened, explains Vjesnik’s source. During Matesic was chief of Sibenik’s POA, he was intimidated twice by shooting on the building he lived in.
As Vjesnik founds out, on Matesic certain pressures was made by Milan Malenica, while he was chief of VOA (Military-intelligence agency). Malenica’s chief, Gordan Cacic, gave him a promotion and now he is employee of management of that agency in Zagreb.

President of Council fo civilian supervision of secret services, prof.dr. Vlatko Cvrtila, announced that the body, which in Parliamentary vacuum is only authorised for control of secret services, would visit all secret services, to get familiar with their work and check whether they work by law.
Is in case of replacement of Davor Matesic was any illegal moves of Franjo Turek, it will be known after finishing work of inspection of Council for civilian supervision of secret services.

Mesic or Faber does the amnesty?
(on croatian at 45 lines, 15.06.2005)

President Stjepan Mesic recently grant amnesty to Stjepan Grandic , third accused from Gospic’s group. Now the lawyers of Mirko Norac are hoping that their client could live to be under Mesic’s amnesty. I wouldn’t be surprised that Mesic give amnesty to Norac, considering that assisstant of President of Commission for amnesty, Vladimir Faber, in relation of best man with chief of POA, Tomislav Karamarko, the person who is extraordinary declined to Stedul people: Miro Laco, Mirko Norac, Mirko Ljubicic Sveps

Vladimir Faber has, in place of deputy of President of Commission for amnesty, replaced Ante Karic, in December last year deceased witness against Gospic’s group.

Faber is by Ivica Djikic’s opinion, deputy of main editor of Feral Tribune, main Karamarko’s candidate for state secretary in Ministry of police, and formerly Globus saw him on place of chief of police.

At the end of last year, Mesic’s commission gave amnesty to Niko Barun, former chief of police in Umag, who was convicted as an orderer of murder of famous Umag’s caterer, Srbislav Petrov, murdered on 2nd September 1991.

Chronology of Barun case:

- murder of Srbislav Petrov, 2nd September 1991.
- The same year in November Barun was arrested
- In December 1992. Barun was convicted on nine years on County court in
Rijeka
- In August 1993. Supreme court abolished the verdict of County court
- In 1994. Barun got out of custody, because at that time state prosecutor, Vladimir Seks, changed the qualification of self-interest murder in plain
murder
- Barun was free since 1994. till 20th August 2003., when he was convicted again on eight years in prison
- On 22nd October 2004. got out of custody after five years, because Mesic has forgiven three years

Branko Skoric, Novi list, 10th November 2004.

Niko Barun, the orderer of murder of Srbislav Petrov, got amnesty from President Stjepan Mesic

By the end of nineties, while he was free, Barun was often seen in Zagreb in Savska Road, where UP was visiting Tomislav Karamarko, at that time assisstant of Minister for personnel in Ministry of police and brought reports to him about hostile activities of certain Istrians (mostly Serbs, but also inferior Croats).

Niko Barun was friend at that time with Zvonimir Trusic, to whom in his bar on Zagreb’s Remetinec used to come Tomislav Karamarko and Vladimir Faber.

I’m afraid that Mirko Norac, even if Mesic give him amnesty, will not have any benefit out of it.

Cicak’s best man Oreskovic

Thursday, July 14th, 2005

Georg Soros sent concrete remark to Croatian Helsinki Committee about the way how Cicak was spending his money

The basic lie which wrote Cicak in his column about Levar is that the deceased witness of war crimes asked money for testifying.
The same lie, one month after Levar’s murder repeated also Zoran Bozic in Hrvatsko slovo.

Levar never asked money from me for testifying, and he also never asked from HHO, affirmed Vesna Levar and also Zdenko Ropac, who was with Levar in HHO in 1996. asking from Cicak to take steps about Gospic story and witnesses who were already at that time jeopardized.
But, unsuccessfulness!

HHO was getting then big financial help from Soros, and philanthropist from USA sent concrete remark to Cicak about the way the money was spending. For that reasons, probably, Georg Soros, during his recent visit to Croatia, with not a single word didn’t mention, and much less praise Ivan Zvonimir Cicak.

The truth is that Ivan Zvonimir Cicak wrote the first text about war crimes in Gospic. But that text is more principled, it doesn’t mention any executioners, especially not Cicak’s best man Tihomir Oreskovic.

Cicak suggests that Levar was also participating in war crimes: At that time Levar was together with Oreskovic and those whom he is accusing today for war crimes.

At that time Zdenko Bando, Zdenko Ropac and Milan Levar were already jeopardized from Oreskovic and Norac, because Bando i Ropac testifyed at Zdravko Mustac, secretary of Manolic’s Office for protection of constitutional order, and Levar was in everything Gospic’s logistics.

About that Milan Levar participated in war crimes I didn’t find and information even on Serbian side. If that was the truth, as Cicak said, with that informations, if not sooner in public, but surely during the trial, would come out Tihomir Oreskovic and Mirko Norac.

Who knows what kind of reports about Gospic war crimes Cicak was giving to ICTY’s investigators, when he wonders that Levar goes so far and directly accuses Norac for serious war crimes, murdering of Serb civilians and mining houses?

The verdict to Mirko Norac in Rijeka confirmed Levar’s accusations against Norac, if we talk about 1991. The trial for crimes in Medacki dzep (Medak Pocket), probably will be held in Haag, and than Cicak will be able to see whether Levar’s accusations about Norac will be confirmed.

On the left to the right seated – President’s advisers: Tomislav Jakic and Budimir Loncar; Georg Soros and President Stjepan Mesic (Over the years, Soros has supported a number of initiatives in Croatia worth more than 45m dollars)
