Marijan Svedrović, Juge � la chambre criminelle de la Cour supr�me de la R�publique de Croatie

Gr�ce � mes bonnes relations avec l�agence de d�tectives �Krtica� (Taupe) j�ai appris tout � fait gratuitement que vendredi dernier, non loin de la place de Grande Bretagne, ont d�jeun� ensemble Franjo Turek ancien chef du contre espionnage (POA) qui a pr�sent� au sommet de l�Etat mes pr�tendues activit�s ennemies et Marijan Svedrović, Juge � la Cour supr�me, l�un des trois juges qui autorisent les mesures secr�tes de surveillance des services de renseignements et de contre espionnage croates (POA et SOA).

La commission parlementaire pour la politique int�rieure et la s�curit� nationale a �tabli que mes droits de l�Homme avaient �t� viol�s mais que Turek n�avait pas viol� la Loi, c�est � dire que j�ai �t� diffam� sans preuve d��tre un ennemi de l�Etat mais qu�en pr�parant cette diffamation Turek n�avait pas utilis� de moyens de surveillance secr�te. Cela signifie que dans mon cas, le Juge Svedrović n�a eu a jou� aucun r�le. A ce propos, nous verrons plus tard !

Ces jours-ci s�est tenue l�audience du proc�s de �eljko Bagić (le sup�rieur de Turek dans la magouille autour de Gotovina et Petrač), contre Ranko Ostojić, l�ancien directeur de la police. L�ancien conseiller du Pr�sident pour la S�curit� nationale fait un proc�s � Ostojić pour sa d�claration � FERAL selon laquelle Bagić, Turek et Pukanić sont des protecteurs du crime organis�. Ce cas est li� au Juge de la Cour supr�me Marijan Svedrović et l�ancien chef de l�agence de contre espionnage Franjo Turek.

Ostojić s�est affront� au cercle autour de Gotovina et Petrač et est devenu lui-m�me victime de l�agence de contre espionnage :

Le lundi 19 avril, Ranko Ostojić, ancien chef de la police, a obtenu la confirmation officielle que des membres de l�agence de contre espionnage, alors dirig�e par Franjo Turek, l�avaient surveill�, mis sur �coute, film� et photographi� sans qu�il le sache. L�information selon laquelle ont �t� autoris�es contre lui des mesures de contr�le a �t� communiqu�e � Ostojić, correctement et en accord avec les obligations l�gales, par l�agence de contre espionnage elle-m�me. Les mesures de surveillance du chef de la police de Račan ont �t� ordonn�es, sur proposition du directeur de l�agence de contre espionnage, par le Juge de la Cour supr�me Marijan Svedrović, connu comme l�ancien avocat de l�organisation criminel (Nikica Jelavić…)! La surveillance du chef de la police a d�but� officiellement le 05 mars mais il n�est pas clair de quelle mani�re est-il possible que la pr�sentation relative au � cas des journaliste � Ostojić � Gotovina �, avec les photographies et les �l�ments sur les mesures mises en �uvre, se soit tenue le lundi 1^er mars, quatre jours avant que les mesures de contr�le d�Ostojić ne soient autoris�es ?! Cela signifie-t-il que l�agence de contre espionnage a surveill� auparavant ill�galement le chef de la police ?

Donc Svedrović a permis � Turek de surveiller l�galement Ostojić et cela a, semble-t-il, renforc� leur amiti�. Turek est appr�ci� non seulement des cercles judiciaires mais aussi des d�fenseurs des droits de l�Homme. Le vice-pr�sident de comit� croate d�Helsinki Veljko Miljević est son avocat et le pr�sident du m�me comit� a pr�fac� son dernier livre d�espionnage, qui peut s�acheter � �Profil�, librairie dont le propri�taire est un autre membre du comit� d�Helsinki Danijel �derić. De plus, Puhovski se voit tous les samedis avec Svedrović au caf� �Charli�.

En regardant tous ces liens, il n�est pas �tonnant que ni Ostojić ni les 5 journalistes qui se sont plaints du traitement des services de contre espionnage n�aient obtenu le soutien du comit� croate d�Helsinki ou d�une autre organisation croate non gouvernementale.

Par ailleurs, aucun des principaux m�dias, except� Slobodna Dalmacija hier, n�ont rapport� l�audience de mon affaire. Il semblerait qu�il ne soit important � personne que le Tribunal ait ordonn� au gouvernement qu�il lib�re l�ancien ministre Vesna �kare-O�bolt de la conservation du secret d�Etat. Le Parlement avait en 2005 donn� un tel ordre au ministre Marijan Mlinarić et ce dernier avait lib�r� Ranko Ostojić de la conservation du secret d�Etat, lequel avait pu t�moigner ouvertement dans l�enqu�te parlementaire sur la surveillance des journalistes par l�agence de contre espionnage. Le Pr�sident Mesić et le ministre Marijan Mlinarić ont parl� publiquement de la pr�sentation de Franjo Turek, violant l�obligation de conservation du secret. Le gouvernement n�a donc aucun argument formel pour ne pas lib�rer Vesna �kare-O�bolt de la conservation du secret.

Je suis le premier journaliste qui fait un proc�s � l�Etat en raison du dommage subi du fait des services secrets et ce th�me n�int�resse ni les m�dias, ni les organisations de journalistes, ni les ONG croates. Je n�ai pas d�autre choix que de chercher de l�aide � l��tranger.

Seventy per cent of listeners of Radio 101 voted in survey whether Josip Perkovic should be delivered to Germany or to put him on trial in Croatia for participating in murders of Croatian emigrants in Germany, that he should be delivered.

By my evaluation, it is the result of distrust in Croatian judicial system.

Else Croatia is not ready to face with dark part of its past.

If there were no international pressure, no trial to Dinko Sakic for crimes in Jasenovac during Second World War , wouldn’t be held.

Considering that nobody from international community didn’t make pressure about partizan crimes, after the war till today not a single trial was held on that theme.

If ICTY doesn’t exist, nobody would be put on trial even for war crimes during Homeland war.
Let’s put on a side silly actions against all those who were during the war on occupied area.

If Germany is not world example how to deal with its own history from Second World War, but also from time of DDR, and if UDBA didn’t kill the most Croatian emigrants exactly in Germany, never would Josip Perkovic found himself in situation to be put on a trial for crimes of UDBA.

The trial to Vinko Sindicic for murder of Bruno Busic, in the very beginning was a farce exception.

The citizens don’t have confidence in Croatian government when it is about Josip Perkovic, it is also possible because of statement of Zlatko Mehun, the spokeperson of police, that police didn’t get anything from Interpol connected with Perkovic, so the headlines in medias are APB before APB. It seems that nobody in police can’t get on Internet, so they couldn’t see German international APB after Perkovic.

Jasna Babic in todays Slobodna Dalmacija consider relative German accusations against Josip Perkovic as an �intelligence war�, �the conflict of Bozo Vukusic with Josip Perkovic�. It is the thesis which several months ago was used by Gordan Malic in Globus, emphasizing that it is the conflict of BND with MI6 for �intelligence dominance in Croatia�.

Jasna Babic has lots of reasons to take in protection Perkovic because on documents which he was in conntact to, she wrote her books: Zagreb’s Mob and Blaskic Conspiracy.

Veselin Marinov, on whose reports she based Zagreb’s Mob, as she said herself in her book, was a personal assisstant of Josip Perkovic, at that time counselor in HIS (Croatian informative service). Perkovic named action of HIS, Barakuda, which was based on reports of Veselin Marinov.

He, through Djurdja Susak, with whom he was extremely close when he got a job in HIS, persuaded her husband to take Ante Nobilo for lawyer defender of Tihomir Blaskic.

As a result of engagement Nobilo and Perkovic in Blaskic case, Babic’s book Blaskic Conspiracy emerged.

* Your new counselor for security Sasa Perkovic, whose father is Josip Perkovic, also experienced intelligence person. Does it mean that you will concentrate more on work of intelligence cervices in second mandate?

-Josip Perkovic after first democratic elections joined in intelligence services, formated Croatian intelligence service and retired. There were thse who doubted in his good intentions, but nothing could ever be said against him. His son is well educated and he worked in services which qualifies him to be my counselor. Because I need advice about functioning of institutions, and that could be the one who comes out of it. I can’t follow everything, and the Constitution says that my duty is to take care of functioning of institutions in the state.

The witness mentioned 14 and 15 April when the IRC representatives visited Lora asking for the permission to enter the military prison because they found out about the unregistreted prisoners captured there. This caused panic so before the IRC representatives entered Lora, Josip Perkovic, Assisstant Minister of Defense in charge of SIS (Secret Intelligence Service) had ordered the transfer of the prisoners.

Slaven Letica) founds a resolution that by receiving patients in hospital and by continuation of work of policlinic, hospital guards physically, but also defends with weapons if needed.

The Perkovic case: Mesic’s little distance and discreete supportPresident Stjepan Mesic about Josip Perkovic, penultimate time, to remind, declared:

And after appearance of German APB, President Mesic said to the same journalist:

In the same way Stjepan Mesic first declare that Hrvoje Petrac is under no investigation, so why then the complaints that with the tycoon is close Damir Loncaric, chief of OA (Intelligence Agency), whose appointment, against Racan’s resistance, President publicly supported.When journalists close to Tomislav Karamarko, the present chief of POA, said that Hrvoje Petrac, by first instance verdict sentenced for kidnapping, is hiding in Israel, Mesic publicly confirmed that, else secret information, but also added that Petrac by Law has right on restoration of procedure, as soon as he comes to Croatia.

At the end of 80-ties, Mesic by his own recognition to Ivica Djikic, the author of President’s unofficial biography The Homeland Twist, monthly, at least twice a year, went on police to give a complaint because he was not getting the permission to make a passport.

Josip Jovic, as a chief editor of Slobodna Dalmacija, during the first Mesic’s president preelection campaign, in continuations published supposed UDBA’s files of later President.But, writes Djikic, Mesic is not disappointed with Jovic’s behaviour, but at that time attitude of Drazen Budisa and Slobodan Budak, that the file is authentic.Slobodan Budak, for whom Mesic said to Djikic, that they were family friends, repeated by The Homeland Twist his opinion:

I am not the likeminded person of Drazen Budisa, and the least of Josip Jovic, but knowing that Josip Perkovic was chief of Udba’s section for enemy emigration, in time when Stjepan Mesic asked for a passport, in order to visit his uncle emigrant in France, and all in light of present situation, I am more and more convinced that Slobodan Budak knows what he is talking about.

In this week’s Feral Tribune one part of stenogram is published from the meeting of VONS in 1993. on which top of the state, led by Tudjman and Susak, were debating about complaints of military policemen: Mario Barisic, Milorad Paic, and under suspicious circumstances, in 1997., suffered, a man from SIS, Tomislav Matic. Together with a part of stenogram, in Feral were retelled bigger part of texts which about Mario Barisic and so called Sibenik’s affair, I was publishing in Globus in 1999., without naming any source. But that bothers me less than the fact that in Feral was also a copy of stenogram which was not available in public in material kind, and state attorney from Split, Michelle Squiccimmaro didn’t want to give it even to Barisic, with explanation that was the act protected by secret.That was less problem than the fact that the scenarist of documentry Lora-testimonies, Pero Jurisin in Nedjeljna Dalmacija in 2001. retold that stenogram (and recently he swore to me that he hadn’t the facsimil, but that he had the right to made only notes) adding that Gojko Susak for Mario Barisic said that he should be eliminated.
Exactly that part was missing in current Feral’s transcript.

Boris Pavelic, after Jurisin’s text, called Ivan Jarnjak, who in 1993. as a Minister of police, was on meeting of VONS and asked him whether the stenogram was authentic. Jarnjak confirmed adding that Susak’s eliminate didn’t have to mean to kill.

Yesterday Mario Barisic, on repeated trial for war crime in Lora, said that because all that he had suffered, got amnesia and he didn’t remember what was happening in Lora.

HDZ- government tried to kill him in the 90-ties. That of coalition, that of third January, he was not needed. Although, a man from SDP didn’t fit in Racan’s politics of forgiving to war criminals. Zeljko Zganjer and Mladen Bajic made a carier on his case, but because of their mistakes from the past of war military prosecutors in Sibenik and Split, although they comunicated with him personally during the investigations, they didn’t have a courage for ojective bill of indictmnet to punish real offenders for war crimes and criminal Barisic was talking about in Tudjman’s office in 1993.

HHO didn’t want to hear for media lynch which was during the first trial for Lora, almost every day against Barisic in all medias, including internet, against so brave and honest Croatian soldier.

Zarko Puhovski told me that Barisic could be accused for participating in crime, and he was willing to help him, if talks in film of his brother, Nenad Puhovski, Lora � testimoniess.Some attorneys didn’t want to press charges against Zeljko Olujic, who in Latinica on theme Storm over Krajina, called Barisic a psychic patient. The chief of police, Ranko Ostojic, didn’t put policemen as a protection for Barisic, who wouldn’t tell him to his enemies, justifying himself that he has no autorities for that, but Sibenik’s police.

Ostojic didn’t take serious the fact that the group connected with runaway Ante Gotovina, and whom Mario accused for war crimes in Kuline, Lora, after in 2003. SIS and SZUP overdropped Barisic’s andmine phone calls and working on chief of Sibenik’s POA, Davor Matesic, in Herzegovina payed people to kill crown witness for Lora.

Marko Erceg from Duga Resa and German Dillenburg, former friend of Stjepan Mesic, Silvije Degen, Tomislav Jakic, Milan Levar, deceased Stipe Suvar, Mira Ljubic Lorger, Wolfgang Thierese, Josip Manolic, Josip Boljkovac, Bernd Schmidtbauer, Smiljan Reljic, Ante Nobilo, Ivan Ninic, Karl Forzner, Josip Perkovic…, helped to transfer to Germany Tomislav Oreskovic, one of witnesses of Gospic war crimes. But he didn’t manage to do the same for Mario Barisic. Mario has got international degree of master of fight with nunchacks. And he wanted to make a living in Germany as a trainer of that fighting sport.

Neverthless, that his attention was discovered, and Marko Erceg was hardly attacked in Slobodna Dalmacija: Secret hunter on evidences of crimes and Heloved to introduce himself as an ICTY investigator.

Did Mario Barisic gave tetimony in vain?

Projection of documentary Lora � testimonies of Nenad Puhovski and Pero Jurisin, again put in focus of public interest Mario Barisic, former military policeman from Sibenik, who first thgough institutions of system, then in medias and then in court gave testimony about war crimes and criminal acts on which worked Militaty police and Safety-informative service in MORH in Dalmatia, during war years.

Praising Mario’s honesty and bravery, Slobodan Snajder asked me concernedly in his mail:
-And why Barisic in Split court didn’t blame somebody else of eight accused, when out of all is clear that they were torturers in �Lora�?

I answered that Mario Barisic didn’t want to lie. He didn’t see that accused from Lora torture and kill. He saw clues of a crime after it were commited: the walls of block C covered in blood, a human ear on the floor in toilette; he heared stories about crimes from other military policemen. To prevent repeating of such things, he informed about his knowledge his superiors all to President Franjo Tudjman.

After his testimony in Tudjman’s office, there was held a meeting of closest state top, on which deceased Minister of defense, Gojko Susak, said that Barisic should be eliminated. When a part of stenogram from that meeting appeared in public, one of the members of meeting, Ivan Jarnjak, in 1993. Minister of police, said that Susak didn’t mean to kill when he said eliminate.

Why that stenogram wasn’t mention in documentary Lora-testimonies, it is not clear to me, particularly considering the fact that scenarist of Lora, Pero Jurisin quoted most of stenogram in his text in Nedjeljna Dalmacija and that he for sure have the stenogram of conversation of Tudjman, Susak, Jarnjak and others about Mario Barisic.

When spokesman of President’s Office, Danijela Barisic in 2001. confirmed that stenogram brought from Office of state attorney, I asked from at that time archivar of President Stjepan Mesic, Zeljko Bagic, to let me insight in that contorverse conversation. Bagic was convincing me that he gave the stenogram to Zeljko Zganjer, at that time County state attorney in Sibenik (today chief of USKOK) and to Mladen Bajic, present Main attorney of Croatia, Mladen Bajic, and at that time County state attorney in Split, and that he had to see what he would do about knowledge from that evidence.

The key evidence which confirms that Mario Barisic informed Tudjman about criminal and crimes in MORH stayed till today unavailable for wide public. Namely it was used in process Lora, but had a mark of secret on it, so even Barisic as witness in process, even after official written demand to State attorney’s office, couldn’t get.

Destiny of Mario Barisic in many ways is similar to Levar’s. After the murder of Milan Levar in Gospic, County state attorney from Sibenik, Zeljko Zganjer, gave him a police protection, which after two years, disapointed, Mario cancelled himself.

Policemen from protection betrayed him to his enemies, and he got informations that certain groups connected with Levar’s murder, but also hiding of Ante Gotovina, prepared his death.

Different from Levar, he received trial for some crimes about which he gave testimony, but he didn’t receive to see that those he held responsible were accused � those who organized the crimes, made it possible, made benefit out of it…

On these pages we will to try to give review of Mario’s search for the truth and justice through institutions, medias, courts. After Levar’s death, state should give him full protection and seriously investigate all his quotation, and not to try to manipulate with his testimony in Lora case, so even Slobodan Snajder could get an impression that Barisic protects direct commiters of war crimes.

If Mario give up for good his hard expedition, it will not be his fault…
